CDWALA and its affiliates provide their services to you subject to the terms and conditions given hereunder. If you visit us at CDWALA, you accept these terms and conditions. Before proceeding further, please read the terms and conditions carefully :
This CDWALA website is managed and owned by M/s Creative Services – Bhilai Nagar. This document sets forth the legal terms and conditions for access to and use of the official website of the company - www.cdwala.co.in. M/s Creative Services and www.cdwala.co.in hereafter referred to as “WE”.
All products/services and information displayed on CDWALA constitute an "invitation to offer". Your order for purchase constitutes your "offer" which shall be subject to the terms and conditions as listed below. CDWALA reserves the right to accept or reject your offer.
These terms and conditions supersede all previous representations, understandings, or agreements and shall prevail not withstanding any variance with any other terms of any order placed or service provided by CDWALA.

This website (www.cdwala.co.in) is created and controlled by M/s Creative Services - Bhilai Nagar.
The laws of India shall apply and exclusive courts in Durg (Chhattisgarh) in exclusion of any other courts shall have jurisdiction in respect of all the terms, conditions and disclaimers.
M/s Creative Services - BHILAI, reserves the right to make changes to the website and the terms, conditions and disclaimers at any time and without information/notification to the customers/users of the services/website of CDWALA.
COMPANY LOGO & TRADE MARK
The logo / images of CDWALA on the home page of the website & other pages and as used in the communication to the user is registered by CDWALA and cannot be used or communicated or distributed without the specific and written permission of CDWALA.
YOUR ACCOUNT
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and also you agree to accept responsibility for all activities that occur under your account or password.
CDWALA does sell products for children, but it sells them to adults, who can purchase with a credit card or otherwise. If you are under 18, you may use CDWALA only with involvement of a parent or guardian or otherwise, CDWALA has the right to cancel any order or service to the User.
CDWALA and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
ORDER ACCEPTANCE POLICY
Online payment shall be made through secured payment gateway using Credit/Debit Card or Net banking. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of the order or our offer to sell.
We reserve the right, without prior notification, to accept or decline your order or limit the order quantity for any reason. For credit/debit card payments, such payment is subject to the approval of the financial institution issuing the credit card and we shall not be liable in any way if such financial institution refuses to accept or honour the credit/debit card for any reason.
TYPOGRAPHICAL ERRORS
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information, we shall have the right to refuse or cancel any orders placed for products listed at the incorrect price.
We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit/debit card has been charged. If your credit/debit card has already been charged for the purchase and your order is cancelled, we shall immediately take necessary steps for making refund as per our REFUND Policy.
PRODUCT AVAILABILITY, DESCRIPTION & PRICE
We cannot guarantee product availability and products, nonetheless, these items may not be available for immediate delivery. We reserve the right, without liability or prior notice, to revise, discontinue, or cease to make available any or all products or to cancel any order. If there is any revision, discontinuance, or cessation, we may, in our discretion, ship products which have substantially similar functionality and specifications to the products ordered or cancel your order and refund shall be made.
CDWALA and its affiliates attempt to be as accurate as possible. However, CDWALA does not warrant that product descriptions or other content or prices/amounts of this site are accurate, complete, reliable, current, or error-free. If a product offered by CDWALA itself is not as described, your sole remedy is to return it in unused condition without opening/tempering the shrink packing, within 7 days of the receipt and claim for Refund.(Please refer to Order Cancellation / Exchange / Return & Refund Policy).
Except where noted otherwise, the Selling Price / MRP / List Price displayed for products on our website represents the full retail price listed on the product itself. Prices mentioned are inclusive of all applicable taxes unless or otherwise mentioned.
LEGAL / GENUINE SOFTWARE
We only sell Legal/Genuine Software(s). Please do not request us for pirated / illegal software(s).
All of the software sold by CDWALA are for single use, on a single machine only. The user agrees to install and use the software only on one machine.
The amount charged by CDWALA for software requiring a registration key / initialization key is on per installation basis. CDWALA shall provide the registration key for these software only once and in no circumstances, second registration key shall be given.
CONDITIONS OF USE : PERMITTED USE
All the information displayed, transmitted or carried by Creative Services through www.cdwala.co.in and its related websites including, but not limited to, news articles, opinions, reviews, text, photographs, images, illustrations, profiles, audio clips, video clips, trademarks, service marks and the like, collectively the "Content", are protected by the Copyright and other Intellectual Property laws. The Content is owned by Creative Services, its affiliates or third party licensors. You may not modify, publish, transmit, transfer, sell, reproduce, create derivative work from, distribute, repost, perform, display or in any way commercially exploit any of the content. You agree to abide by all copyright notices and restrictions attached to any content accessed through the www.cdwala.co.in website and not to alter the content in any way.
You may take a single copy of the content displayed on the www.cdwala.co.in for personal, non-commercial use only, provided that you do not remove any trademarks, copyright and any other notice contained in such Content. You shall not archive or retain any Content in any form without written permission.
Creative Services reserves its right to terminate your account without any prior notice for any violation of the Conditions of Use.
ORDER CANCELLATION / EXCHANGE / RETURN & REFUND POLICY
(In compliance to the Electronic Commerce (EC Directive) Regulations 2002 & Consumer Protection (Distance Selling) Regulations 2000 Notices to which Moneybookers complies.)
Please select your purchases carefully. RETURNS (If any, due to any reason) must be PRE-NOTIFIED.
DEFECTIVE PRODUCT / PRODUCT EXCHANGE : Prior to returning any DEFECTIVE product or for EXCHANGE, back to us, please send an e-mail to creative@cdwala.co.in with DEFECTIVE PRODUCT RETURN or PRODUCT EXCHANGE in the subject line; please include your order ID number, name and address and a brief explanation for the reason of your return.
ORDER CANCELLATION - Cooling Off Period : Any product can be returned (in sealed, un-opened & unused condition as received, with original packaging & CDWALA sticker on it) by customer within 7 working days of the receipt of the material at customer end, with prior notification through e-mail, mentioning your order ID number, name and address, with PRODUCT RETURN – NO REASON in the subject line of e-mail. In this case REFUND shall be made after deducting the shipping charges as per our REFUND policy.
Please dispatch the material back to us ONLY after receiving confirmation e-mail from us. Do attach a print copy of our e-mail message along with the shipment. We should not be held responsible for any shipment prior to or without our confirmation e-mail.
All items must be returned within 7 days of receipt for REPLACEMENT / REFUND / EXCHANGE. For all orders, please allow up to 2 weeks to receive your REPLACEMENT or REFUND or EXCHANGE.
REFUND POLICY : In case of ORDER CANCELLATION refund should be made in compliance to the REFUND / CANCELLATION policies of payment gateways. In Case of payment made through Net Banking - services charges and taxes levied by ICICI Bank on deposits from non-base locations shall be deducted at actual.
In case of PRODUCT EXCHANGE / ORDER CANCELLATION product packaging should not be opened or tempered, it must be sealed and also contain CDWALA sticker on it (i.e. product should be returned in the same condition as received at the customer end).
Please, do obtain a tracking number from a shipping carrier when sending a return. We are not responsible for returns lost /damaged on the way back to us.
SHIPMENT & DELIVERY
Shipping and Delivery
Shipment of all products ordered via the CDWALA Online Store is done from our base location in Bhilai Nagar. In case of non availability of item at our base store, we may arrange to ship items from multiple locations around the country. This is just to serve you better and reduce the delivery timings.
Please ensure that your billing and shipping addresses are correct. We may not be held responsible for delay in delivery of material due to mistyped/incorrect billing and shipping addresses. Orders will not be shipped to a Post Office Box. We are not responsible for any shipping problems and shall not be held liable for any "reasonable" delay beyond our advertised delivery time-frames. Shipments that are delayed due to causes beyond our control, including, but not limited to, the following: the unavailability or refusal of a person to accept delivery of the shipment, delays caused by the consignee, acts of God, public authorities acting with actual or apparent authority on the premises, acts or omissions of Customs/Octri/Naka or similar authorities, riots, circumstances arising before, during, or after a strike or other labour disputes, civil commotions, disruptions in the air or ground transportation network (such as weather phenomena), and natural disasters.
Do not place orders for items marked "OUT OF STOCK". These orders will be automatically cancelled.

For Shipping abroad : Presently Shopping Services of CDWALA is being offered in INDIA only. Customers outside INDIA may please send your requirements to us thru E-Mail for prices and shipment details. Delivery outside India may be arranged on special request.
Tracking of Shipment : We forward the Shipment details to customer using E-Mail & SMS. You can track the shipment on respective courier site as provided in the shipment detail.

DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY
CDWALA has made this service available to use as a matter of convenience. CDWALA expressly disclaims any claim or liability arising out of uploading of any obscene, vulgar or pornographic images, photograph or a picture or altering or distorting the images available under this service in an obscene, vulgar or pornographic manner. CDWALA also disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. CDWALA does not warrant that this site, its servers, or e-mail sent from CDWALA are free of viruses or other harmful components. CDWALA will not be liable for any damages of any kind arising from the use of this site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
CDWALA does not endorse in anyway any advertisers/ contents of advertisers on its web pages or other communication. CDWALA will not be responsible for any damage suffered by Users from use of the services on this site. This without limitation includes loss of revenue/data resulting from delays, non-deliveries, missed deliveries, or service interruptions as may occur because of any act / omission of the vendor. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, torturous behaviour, negligence, or under any other cause of action.
CDWALA shall not be liable for any delay / non-delivery of purchased goods, due to flood, fire, wars, acts of God, mistyped / incorrect billing and shipping addresses entered/provided by the user or any cause that is beyond the control of CDWALA. In case of delivery due to mistyped / incorrect billing and shipping addresses our liability ceases with the delivery of the material at specified address.
To be on the safer side user must send us an e-mail indicated the transaction details along with the billing and shipping address.
In the event that a non-delivery occurs on account of a mistake by you (i.e. wrong/mistyped name or address) any extra cost incurred by CDWALA for re-delivery shall be claimed from the User placing the order.
All prices, unless indicated otherwise are in Indian Rupees. The availability of products is subject to change without prior notice at the sole discretion of CDWALA and orders can be cancelled if the product goes out of stock.
CDWALA reserves the right to refuse or cancel any order placed for a product that is listed at an incorrect price which may be higher or lower than published. This shall be regardless of whether the order has been confirmed and/or payment been levied via credit card or cheque or otherwise. In the event the payment has been processed by CDWALA the refund amount shall be credited to your credit card account and duly notified to you by email or sent by cheque.
In a credit/debit card transaction, you must use a credit /debit card that is issued in the name of the User. CDWALA will not be liable for any credit/debit card misuse/fraud, because of the card being used fraudulently. The liability to use a credit/debit card or a net banking transaction fraudulently will be on the User and the onus to 'prove otherwise' shall be exclusively on the User.
Reviews, Comments, Communications, and other Content
Visitors may post reviews, comments, and other content; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing on intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content.
CDWALA accepts no responsibility for the content, accuracy, conformity to applicable laws of such material.
CDWALA reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.
If you do post content or submit material, and unless we indicate otherwise, you grant CDWALA and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant CDWALA and its affiliates and sub-licenses the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify CDWALA or its affiliates for all claims resulting from content you supply.
